Pandora’s box

Now everyone goes to court for legislative assembly or parliamentary matters… Doctrine of separation of powers what?

1. YB Gobind Singh, MP of Puchong took his suspension and strip of MP privileges to court.

2. YB Wong Ho Leng from Sarawak legislative assembly is planning to ask court for a review on his suspension from the DUN due to a ridiculous reason of the use of word “camouflage”! Frankly speaking, if using the word “camouflage” is a disgrace, I’ll have to feel ashamed to my project then…

3. YB Mohammad Khir Toyol Toyo threatened to sue the assembly if he’s banned from the house, for not attending the parliamentary committee’s hearing…

4. Speaker YB Sivakumar is of course asking the court to clarify who is the true speaker of the house after the disgraceful DUN Perak sitting at 7th of May.

I don’t blame them… Myself being a bias creature think that case 1 and 2 are just typical of Majority bullying the minority. Case 4 is strictly speaking not a challenge to an assembly proceedings consider that the speaker was illegitimately removed when he had not even called for a start of assembly. As a result, case 4 can be considered more like a certain moron named Ganesan who calls himself speaker of the state legislative assembly had conducted a crime for “gate-crashing” the assembly, and even “called” some hundreds or tens of not even uniform-wearing personnel into the assembly (which is also a crime!).

Case 3 is what cantonese says, dei sei… Call me bias… but you are legally bounded to attend the hearing at the very first place!

Anyway, the point is, Article 72 (1) of the Federal Constitution, in black and white states that:

The validity of any proceedings in the Legislative Assembly of any State shall not be questioned in any court.

So how dare these people, except maybe in the speaker vs speaker case, challenge the legislative proceedings? In fact speaker of the house can actually order an arrest on these people!

Thanks to Court of Appeal president Justice Alauddin Mohd Sheriff, Chief Judge of Malaya Arifin Zakaria, Federal Court Judges Nik Hashim Nik Ab. Rahman, S Augustine Paul and Zulkefli Ahmad Makinudin. Remember these names…

They opened the pandora’s box to “legitimatize” all the assaults towards the legislative pillar of the country.

They, in the judgement over illegal MB Zambry et al. vs Perak house speaker, ignored the federal constitution, and basically told us that “NOW EVERYONE CAN SUE THE HOUSE”, Air Asia style…

No written judgement on it to date…

And we call them Justice.
